Who Can Obtain Unemployment Insurance in New Jersey

NJ state logoUnemployment insurance is a program that assists the laid off worker meet financial obligations while seeking a new job. The file for unemployment insurance over the internet 24 hours a day, 7 days a week or by telephone. Most employees with a steady track record of employment qualify for benefits. In order to prevent incompetent individuals from using up the state unemployment fund, New Jersey sets eligibility rules.

Eligibility for New Jersey Unemployment Benefits

To ensure you follow the rules, The Department of Labor and Workforce Development (DLWD) has a detailed process for determining eligibility.

Non Monetary Eligibility

In order to start your unemployment, NJ unemployment requirements include the following:

  1. You are totally unemployed. Depending on your vocation and industry, you may qualify for unemployment if you have had your hours reduced.
  2. several thousand people demanding jobYou are able and available for work. If you are unable to work because of medical condition or disability, you may not meet the NJ eligibility requirements, but you must apply anyway. In case you are not qualified for unemployment, you may be entitled to obtain disability benefits.
  3. You are registered for work at your Workforce Development Center. You should do this when you apply for unemployment, and every week whenever you certify your weekly claim.
  4. You have lost your job through no fault of your own. New Jersey also considers the reason for unemployment when deciding eligibility for benefits. Workers fired for misbehavior from previous employment may not be entitled for benefits depending on the severity of the incident. New Jersey categorizes misconduct into 3 types including severe, simple and gross. Workers in New Jersey who give up a job must have good cause to qualify for unemployment benefits.
  5. You also must be ready, willing to take on new work and must apply to a minimum of two jobs per week.

To keep on receiving weekly unemployment benefits, NJ unemployment requirements state that you must file a ‘weekly claim’ by doing the following:

  • Meet all of the NJ unemployment requirements listed above.
  • Apply for at least two jobs each week.
  • Get in touch with the New Jersey unemployment office to file your ‘weekly claim’. You can do this via phone or online.

Monetary Eligibility

In New Jersey, workers must earn sufficient money during the base period to be eligible for unemployment benefits. The state requires workers to have been employed for at least 20 weeks in a covered position or have earned at least $7,300. Covered employment refers to services performed by a worker that is subject to the New Jersey unemployment compensation law.

Earnings

According to the New Jersey DLWD, employees mustearn 1,000 times the state minimum wage of 7.25 an hour in a lesser period of time to apply for unemployment insurance since March 2011. To qualify, employees must achieve this requirement with atleast one employer and the wages must have been earned during a 52 week period which is called a base year.

Base Period

The state employs a base period to decide the benefit amount as well as monetary eligibility. The base period is a 52-week period and depends on the date of your claim. It is normally the first 4 calendar quarters of the last 5 completed calendar quarters. You must have earned a minimum dollar figure for every week worked during this period. In 2010, this minimum sum was $145 per week. There are alternate plans that may come into effect if you did not meet this 20 week condition. The unemployment department will see the previous 18 months and make a decision about eligibility.

Weekly Benefit Rate (WBR)

Weekly benefit rate is the sum of compensation you collect per week. It is 60% of your average wage during your base year. There is a maximum total that may change each year. For 2011, this maximum is $598 per week. In case you do not obtain the maximum sum then it can be increased through dependency benefits.

Dependents

DependentsApplicants obtaining a weekly benefit sum less than the maximum of $598 may receive added benefits for dependents. The state of New Jersey will pay an extra 7% of the benefit amount for the 1st dependent and 4% each for two more dependents. The claimant may not receive more than the maximum weekly benefit amount with dependents. You can collect 7% more for a 1st dependent and 4% more for each of the next two dependents. You must present proof of dependents within 6 weeks of starting the claim. If no evidence is provided, you will not collect any dependency benefits. Maximum Benefit Amount

The maximum benefit amount is the total sum of benefits a claimant may obtain. It is computed by multiplying the WBR by the number of weeks worked during the base period. This sum cannot go above 26 weeks. If you have returned to work earlier than reaching your maximum benefit amount but then you become laid off once more you may revive your claim only if a year has not lapsed since you started your original claim. In case more than a year has lapsed, you have to file a new claim. While receiving benefits you should be enthusiastically looking for work and make at least three employer contacts a week.

Re-employment Orientation

As part of New Jersey’s unemployment program, you may be needed to be present a re-employment orientation meeting. At this group you will get a presentation on accessible services and training opportunities. This comprises training in demand occupations, veteran benefits and career counseling. You will be allowed free use of equipment that will help you in your job search. In case you fail to be present at this meeting, you may have your benefits delayed or denied. This situation also applies to any listed meetings that you may have with employment analysts.

    I am working as a substitute teacher in Teaneck District.

    My work has slowed down. Certified teachers have been taking jobs as they are offered to me by Aesop. the computerized system that seperates cerified and non certified teachers. I am a holder of a BA, which is a requirement in the District, and yet when I am called and jobs are offered, as I am accepting the job, the system tells me that the job is no longer offered to me.I understand that wherever a certified teacher is found they are to be hired first, come on, then why let Aesop call me at all? And why hire non-certified but BA musts if they will not offer at least part-time pay? Also I have detected that in preferences in the Aesop system shut off calling me, which is the only way non-certified teachers are called. I have reported this to Human Resources with no reply. And this has happened on more then one occasion.
    Due to lack of work, suddenly my work days have been cut. I am more then ready and able to work, but due to what I consider unethical work practices,such as “sniping” I am now wondering if I now am able to collect partial unemployment benefits, which I pay for.
    I have received benefits in the past, but now it seems harder to receive them. I am happy to look for more work and will do so without prompting from work force development. I have made so far for Feb. a total of 250.00. I was making at least 1,200 per month, but suddenly Feb.came and Aesop calls and then hangs up abruptly, or completes the offer of a job and suddenly takes it away. And still no reply from the receptionist at the Board of Ed.

    i had been working and living In Long Island and moved to rockland county for a new job at Newark airport. Due to Port authority badging process which takes over 2 months my company stopped paying me after 1month and am still technically employed but not getting paid.     I am currently employed by A&P in a stand alone liquor store. We are told they are going out of business by Dec 31, 2015. I picked up a temporary seasonal job overnights. The hours are many and I want to leave A&P. If I quit A&P before they go out of business, can I collect unemployment? If a new company does buy my location, but wants to cut my pay, can I collect unemployment if I do not accept the job?

    I was disqualified for benefits in Sept because I resigned from my teaching job. I was told through my requalification determination that I would need to work 4 wks and earn 6x wkly benefit.
    I was hired as a substitute for a local school district. When school closes for the year in June and I satisfy the requalification requirements will I be able to receive my original unemployment benefits?

    Hi Nick, My son has left his job because of some work safety issues. His job required him to lift heavy equipment on and off his delivery truck for instillation. He was repeatedly promised over the years that a truck with a lift gate would be provided to prevent back strain issues. To prevent personal injury to his back, he decided to leave the company. The company had trucks with lifts in other parts o NJ but never fulfilled it’s promise to provide a lift gated truck. Can he claim unemployment? Thanks Tony

        The more recent was NYC, and I collected benefits from that work. The benefits ran out after 26 weeks. Somehow – they never explained it – NYS never went to the NJ employer. I thought that they were going to forward my case to NJ, but NYS did not. Can I now file in NJ using the NJ income?

    I’m 61yrs old, I’ve worked as a clerk for just shy of 2 &1/2 years. It was part time ( under 30 hours per week) My employer says I don’t fit into the budget as of the end of this month,( it’s a very large company) I work directly for two partners who were told they are responsible for my pay now. They are unable to do so. Can I collect? I have never done so, unsure where to begin.

    I worked at a retail store in NJ from May up to December in 2015, then I worked in H&R Block throughout the tax season in 2016 and after it ended I became a substitute teacher in the Passaic District.     I was a salesperson earning a salary plus commission for many years at the same company. In March I was informed my salary would be discontinued and changed to a “draw” against future commissions. Thus, commission only moving forward beginning April 1st. I resigned at the end of April.

    My job recently announced layoffs and potential numbers for the layoffs. They have put out a package for severance if volunteer for layoff. Based on my seniority with the company I fall into the number of layoffs and if i am a forced layoff I will not recieve severance. If I volunteer will I qualify for unemployment benefits

    The requirements state that you should be working in NJ for the last 18months. I worked in NJ for 5mo and was laid off, prior to that, I worked in PA, so I worked in 2 states in the last 18mo.     I work in a grocery store and I accidently mispriced a fruit bowl. I was given a verbal warning which I accepted. 3 days later I was told by my employer that I had the choice to resign and be able to collect unemployment and they wouldn’t fight it or I’d be terminated for misconduct. I took the resignment considering it would be better for me to collect benefits. Now since it was the employer’s idea for me to resign, should I be available for unemployment?

I tried very hard to find a full time job at different districts, but unfortunately I found a substitute teaching position at Tenafly High School and is going to end by mid October. My other part time teaching position is at Bergen Community College and it is going to end by December. Am I eligible to apply for an unemployment benefits in December?

    I have a question I have never been not working I have been working with same company for 13 years but then I got a better job so I left on great terms I have been with this new job for almost 8 months and had to resign. Now I’m worried I won’t be able to collect here’s my situation my daughter has a medical condition and her doctor took me out for 2 months I couldn’t apply for fmla so I asked my job for a medical leave of absence which they couldn’t give me the time I needed told me in writing if I couldn’t return I should consider resigning. OK so I went to HR tried talking to them about going part-time temp so I could take care of her they wouldn’t do that either. Then I even asked if I returned sooner than doctor wanted would I be able to take off for her doctors appointments which were once a week they told me no I would need to earn more time before I could take anytime off. I have medical certificate her doctor filled out and everything and all emails back and forth to HR. I ended up in HR last week trying to save my job but they said if I couldn’t return that day I should resign which in tears I ended up doing they also told me I’d be able to collect unemployment but now seeing all the rules on resigning I’m worried. I have had a job since I was 16 this is my first time ever not having one now I’m worried. I plan on finding a job again after everything is good with my daughter but now I’m worried meantime I will get denied now. I didn’t know how this works I am scheduled with phone interview next month with unemployment. Does anyone know if I’ll be OK

    My husband’s company was purchased and the new owners have lofty goals of cost savings, to the tune of $90M in the first year. They have sold off equipment, laid off employees in other states and told contracting companies to hire staff. They offered a voluntary buy out package to employees that meet the Rule of 70, which he does. They have made it clear that packages may not be offered later and that acceptance of this package is completely voluntary. That have also stated that they have no immediate plans for lay offs but they have to say that. Will he be able to collect if he accepts?

As long as he meets the unemployment criteria, is there any issue with his eligibility based on the number of credits that he takes in college?

    My daughter verbally resigned from her job and was held to it. She was under emotional distress due to HIPA violations that were occurring in the office, that were brought to mgmts attention by my daughter. An office manager was disclosing my daughters medical issues to some girls in office, most serious issue was my daughters name was forged by an uncertified medical assistant. She went to appropriate people and they did nothing. The stress mounted, she verbally resigned and was held to it. My daughter has since sent letter to regional office and the girl that forged her signature was fired and policies now enforced, but now she is out of a job. After the fact, they realized everything she told them the day she resigned under stress was true, still no job, sacrificial lamb so to say. Would she be able to correct unemployment benefits for this? I am not the type to go the lawyer route, but now she has no job….

    I recently was told to leave my job after getting yelled at by my office manager. He is telling me I resigned which is untrue. I have worked for this dental practice for 5 years. My manager was very difficult to work for. He managed by intimidation and often spoke to me with a hostile and angry tone. Whenever I brought an equipment problem or brought something to his attention that he should be made aware of like supplies needing to be ordered, or an equipment malfunction, he would always become almost irate as if the problem being brought to him was my fault. This treatment continued for nearly two years until I couldn’t take it anymore and brought it to the Drs attention – the Dr owns the practice and my manager is married to him. When I brought this hostile treatment to the drs attention, he called a meeting to discuss and during the meeting, my manager repeatedly tried cutting me off while I spoke, raised his voice several times. The Dr saw this and told my manager he was treating me unfairly. We tried to wipe the slate clean and start over so to speak. Things were ok for a few weeks but my manager now was basically barely speaking to me which became very awkward and frustrating. Still when I needed to go to him for work related issues, he was still hostile and very unapproachable. I dreaded having to go to him about anything for fear that he would become angry and unreasonable. There were several occasions when other people in the office could hear him during angry outbursts which made them feel uncomfortable. Many people in the office would ask me how I could put up with his treatment. It was very difficult. I was a very reliable employee, I worked extended hours without resistance, I helped build the practice to what is today, have had glowing annual reviews, and have even been told during these reviews that my work is outstanding and that I was an asset to the practice. The angry outbursts and hostile intimidating treatment became too much to bear. On the last recent outburst, my manager yelled at me to leave. I left because I was beaten down by him and after taking it for 5 years, I had finally reached my limit of what I could endure from his treatment. The next day I received an email from him saying they are processing my resignation. I did not resign. I was told to leave. I’m heart broken at what happened to me because despite all of the harsh treatment, I loved my work and the patents I helped on a daily basis. What do I do? Will I be able to collect benefits?

    I work as a teachers aid full time. We get medical full year. We get notified each August if there is a position for the next year in the same class. I have always had great ratings. This year the teacher had to take leave due to the stress (autistic kids) and I was stressed even more because of the teacher. Finally they replaced the teacher with someone who immediately took a dislike of me, including a nationality remark. I complained and they moved me to a new class and that teacher loves working with me. Today, they told me that I will NOT be renewed in the fall, and that it is better for me to turn in a resignation letter so it’s easier to get a new job. In either case (resign or not renewed ) can I get unemployment starting in September? This decision has to be made by Thursday.

    I work in a physician office for over 30 years. Doctor has reduced the work force here by over 50% in the last five years and the burden of the extra work falls on my shoulders. I cannot get my work done in a day and the stress of the job has built to where I cannot even think straight when here. I have complained via email and personal discussions many many times to both the doctor and his wife who two years ago took an active role in the practice. My words fall on deaf ears and all I am told is how do other doctors do it… I feel the patient care is compromised because there is not enough staff in the office. On top of all that, I am entitled to 25 days vacation each year and the doctor decided for 2018 that you must accrue days out before they are taken so I won’t even get paid for an upcoming planned February vacation. If I leave this job to find another, am I entitled to collect unemployment in this situation until I find another job. ??

    I’ve worked as a full time Xray Tech for a company since July 2017. I was just told that they might be bringing me down to per diem status possibly within the next two weeks. What that means is that instead of working my 40-50 hrs/wk they “might” give me more like 20 instead. Would I be able to apply for unemployment until I find another full time or other job to make up for those lost hours/money?

    I was employed at 2 jobs for 2 years from May, 2016: one was a full time factory job which I was released from due to downsizing on Dec. 8, 2017. I am still employed part time as a pharmacy driver- I started working that job in May of 2016 as well.
    My question is this- why are my part-time wages from my second job deducted from my unemployment pay? The part time job preceded my unemployment. I only receive $89/week in benefits after this deduction is made. It’s as if I’m being punished for working to help myself out!
    I’d make more money from my unemployment claims if I just quit the part time job- I wouldn’t be able to live with myself if I did that, but this seems ridiculous to me. I don’t see this information anywhere online- the part where a previous job is deducted from an unemployment claim before payment. Can you direct me to that law?

A lump sum, based on years of tenure will be added to our non contributory pension plan. When we decide to withdraw we must withdraw the entire amount either in a lump sum or monthly installments.     Hello! I have worked for the my employer for over 5 years of which 3.5 years I have worked entirely remotely. After notifying my employer of a miscarriage they dissolved (they use the word evolve) my current position and have advised that I either need to take a promotion and work 33% of time in office and have in home childcare (which they know I do not currently have) or work for them under a 1099. With a young child the cost of childcare would significantly lower my weekly take home pay (by about half) as I work with her home now. If I take the 1099 route and become pregnant again I won’t be eligible for a paid leave or unemployment should they decide to dissolve my position again. I feel that I cannot take either of their offers but if I do not am I eligible for unemployment benefits until I find a new job?

    Hello, I worked as a salesman in pa for the last 3 yrs and had an injury and was out for 3 months. I was they wanted me to do another position upon my return. Before my injury I was put on and off salary and commission to just commission 4 times in 3 years with my most recent terms being 100% commission. I live in NJ and found it to costly to continue working there as I found myself spending more money getting to work per week than i was making sometimes. So i quit and took a job offer before my return to work date in Nj. It’s closer to home and less costly. I jave been employed since 1/2/18 and there are days where we dont have work and can claim unemployment. Does the money i made working in pa carry over to nj? Will i qualify for benefits if I meed them?

They offered me the position which is about $15,000 less than my previous job . My question is if I take it will I lose my unemployment benefits?     I have recently been reassigned to a different work function within my department. The function is somewhat similar but certainly not as financially lucrative as the function I was hired for.
    The reason I was given for the change is because I have recently acquired protection under FMLA rules for the care of my wife. I was told that when my FMLA expires we will renegotiate my future within the department.
    I find this to be somewhat retaliatory and feel extremely uncomfortable working here. My performance has always been award winning. This came as a disturbing surprise because I was not given any warning or opportunity to show my continued performance.Could I resign under those conditions and collect unemployment while I seak another position?

    I reside in Pa and worked in NJ. I was displaced and exhausted all benefits. I am eligible for ABT; upon going to the OneStop career center on 1/22/19,I wasn’t given much information. Which left me discouraged as I am new to the whole Unemployment process. I would like to enroll in training (ABT) however I am unaware of my options, as the employees in the Elizabeth (one stop career center)location make you feel as though you’re bothering them, when asking for clarity.     I had a full time PT job in NJ nursimg home in 2014. My job status was changed to Per Diem on June 2016 because of lack of hours work due to low census or slow admissioms in the facility. I’ve been working as an in house Per Diem PT in multiple SNFs to get enough hours per week. For 3 years I was gettimg enough hours to give my family the basic necessities of life and survive. I tried to avoid applying for Unemployment Benefits but since last month until now I barely getting hours of work due to new 2019 Medicare change in SNF. I decided to apply because my wife’s salary is not enough. I’m a W2 employee, I just want to know if I’m eligible before applying?. Thank you.

They have extended it a few more months and said will determine by January if can be taken on as perm.     Greetings from Manila, Philippines, where I am based. After the company of Louis Berger Group (headquartered in Morristown, NJ) was acquired by the larger Canadian firm WSP as the end of 2018, my Philippine program manager / country manager position was deemed redundant and I was laid off in early May 2019. I have been unemployed since then but continue to pursue applications for overseas employment opportunities since I have been based in the Philippines for the last 40 years.
    The NJ Dept of Labor has to date denied my applications and appeals to access the unemployment insurance that I have paid for over the last 24 years of working with the Louis Berger Group. The main / final objection of the NJ Dep of Labor is that I am not eligible for NJ unemployment insurance since I am residing overseas, where I have been working and residing for the last 40 years and paying NJ unemployment taxes for the last 24 years.
    Currently my appeal is at the NJ Board of Review for final decision by filing a Notice of Appeal. My appeal needs to be submitted within 45 days of the last mailing date of Oct. 2, 2019. I can complete most of the necessary form (attached). Is it worth the effort to file a final appeal to the Appellate Division of the NJ Superior Court?

    I worked as a pharmacist making well over the maximum from July, 2017 through April, 2018 on a 1099 through a consulting firm. At that time, I developed an infection in my right foot that ultimately required a below the knee amputation. The pharmacy replaced me without any written warning or documentation whatsoever. The healing process took over 6 months. I applied for short term disability and was denied because they said I was a consultant and not an employee. I appealed the decision and won the appeal on the basis that I should have been classified as an employee, not a contractor. However I was only awarded about 3 months of disability and never received any documentation from them as to how much time was actually awarded nor how much I received. I was physically unable to work until January, 2019. I have been employed full time since May, 2019. At this time…November, 2019, can I retroactively apply for UI from the time my disability terminated through the time I secured new employment? Thanks I know this is a complex one.

    I will have worked well over the 20 weeks and made about 18,200 in wages.

    1. What date should I submit the claim? I see other states tel the teachers to submit it 7 days before the last day. So I a curious as to what date I can actually submit them.
    2. Do you need to put every job you worked during that base period, even is one was for jus a month?
